Legal And Allowed In An Illegal Situation: The Growing Legal Issues Surrounding Marijuana

More and more states are legalizing marijuana for both/either recreational and medicinal purposes. While that is good news for many proponents of this drug, it is not such good news for many police officers who stop people in cars and make arrests on possession charges. In fact, there is a whole new set of legal problems to come out of the individual states legalizing marijuana, and it has everything to do with people traveling between states where it is legal here, but not legal there. It has given rise to a new "branch" of law: interstate marijuana possession and practices. Here is what they do, and where and when you might need an interstate marijuana defense lawyer.  

You Took Marijuana for Personal Use from One State Where It Is Legal, and Drove into Another State Where It Is Not

When you live in a state where marijuana use is legal, and/or you carry a medicinal use card so that you can secure some marijuana and use it, you expect that you should be able to travel with your medicine anywhere. That is a common mistake that most clients in a similar position make, and why they end up in jail when they are in a state where marijuana has not yet been made legal for any purpose. Clients also tend to forget that marijuana is still federally illegal, which is why they were stopped and arrested in these anti-marijuana states. If you took marijuana from your home state in your car for a road trip to other states, and you were stopped, searched, and arrested as the result, you are going to need one of these pro-marijuana attorneys. 

Your Defense Is Exactly What It Is

Even though the police arrested you "red-handed," you should still say nothing to them. Ask for a lawyer, and then make sure the lawyer is an interstate defense lawyer and a proponent of marijuana. Do not accept or hire any lawyer that is not, or you will end up serving jail time. Your defense, according to these special attorneys, is that you are allowed to buy and use this drug in your home state. If you have a medical condition, you are also allowed to carry your marijuana medicine with you on the road, and you should be permitted to do so, even when it is not allowed in another state. The rest of your defense rests on whether or not your vehicle was illegally searched by the police, which may help get your case thrown out of court.
