Has Your Spouse Taken Off With The Kids? Take Action And Get Help Today

If your spouse has decided they want to leave you and they have taken off with the kids, you need to find a lawyer. A family lawyer that is familiar with child custody cases can help you work quickly and take action if you fear that the children may be at risk.

There is a lot of information your lawyer will need to have about the case, and many laws that make taking the children illegal. Be prepared to share the following information with your lawyer so that you can be sure to see your kids while you are going through the divorce process.

Reason for Leaving

Your spouse is allowed to decide that they no longer want to be in the marriage, but they aren't allowed to leave with your kids, not tell you where they are, and keep the children from you. If your spouse can't provide evidence that you are an unfit parent, or a danger to the kid, the lawyer will work to get you visitation quickly.

Not only that, but the other parent could potentially face charges for these actions, based on how long they withheld the kids.

Evidence of Risk or Danger

If there is any reason for you to question the mental health of the spouse that has your kids, or if they suffer from addiction or other problems, you want to meet with a lawyer immediately to take action. Evidence would include:

  • Text messages threatening to harm the children
  • History of addiction or current battles
  • Past problems with mental health concerns
  • Recent strange behavior

Legal action may be the only option. If you have not seen that the children are healthy or had a chance to talk or communicate with them in any way, a missing person's report may have to be filed.

Custodial Outcomes

Be prepared to have custody of your children if they are recovered from your spouse. This may mean needing childcare, a home inspection, and providing other information. The authorities will determine how to get the children back — and who will be awarded custody or how to split the custody — while the divorce process is underway.

Your spouse can't leave and take your kids because they want to leave you. Call a child custody lawyer right away, and the police if you fear for the safety of your kids, and get the case started as soon as you can.
